The Impact of Italy’s Competition Authority Fine on Meta

Italy’s competition authority recently imposed a fine of 3.5 million euros on Meta for its lack of transparency in handling data and managing Instagram and Facebook accounts. The AGCM watchdog highlighted Meta’s failure to promptly inform users about the commercial use of their personal data on Instagram via the web. Additionally, it pointed out that Meta did not adequately handle the suspension of users’ Facebook and Instagram accounts, failing to provide clear information on the decision-making process behind these suspensions.

One of the key issues raised by the Italian watchdog was Meta’s failure to inform Facebook and Instagram users about their rights to contest account suspensions. The watchdog noted that Meta did not provide users with information on how to engage in an out-of-court dispute resolution process or seek judicial intervention to challenge suspensions. Moreover, Meta imposed a short 30-day deadline for users to appeal suspensions, limiting their ability to effectively contest the decisions made by the platform.

Following the initiation of the investigation by the Italian competition authority, Meta made several changes to its practices aimed at addressing the concerns raised. Meta stated that since August 2023, it has enhanced transparency regarding the use of data for advertising on Instagram and improved the information and options available to users for appealing account suspensions. Despite these changes, Meta expressed disagreement with the authority’s decision and is currently evaluating its options in response to the fine imposed.

The fine imposed by Italy’s competition authority on Meta underscores the importance of transparency and user rights in the digital sphere. Meta’s lack of openness in data usage and management of accounts not only violated consumer trust but also raised concerns about fair competition practices.
